Divorce mediation allows parties to compromise, not win or lose

The arbitration process for divorce cases can be long and drawn out in Denver and other cities throughout the U.S. With parties contesting factors such as division of property and assets, child custody, visitation and support payments, reaching a divorce settlement can take months or even years and is often incredibly costly, both emotionally and financially. In order to lessen the emotional stress and financial expense of divorce, more and more couples are turning to divorce mediation.

In three counties in Oklahoma, there have reportedly been at least 700 total divorce cases settled using mediation so far in 2013. That is up from a reported 58 divorce mediation cases in 2006. While the increase in cases using mediation is in part due to the high divorce rate, it is also due to more and more experts recognizing the validity of the process and recommending it to clients who have filed for divorce.

Through mediation, couples are able to freely discuss the issues that need to be settled. Rather than a judge issuing a ruling for one party over the other, the people who are familiar with the issues are able to come to a compromise and a judge is able to agree to the terms. Many find this removes much of the contention between parties, allowing for a quicker, smoother resolution so everyone involved can move forward.

If you are considering divorce, mediation may be an option for helping to settle your split without a lengthy legal dispute. It may be of benefit to consult with an attorney who is experienced with mediation to discuss whether or not it is right for your situation. A lawyer can explain your options to you and help you decide how best to proceed, as well as answer any other questions you may have.
