Benefits of mediation in divorce proceedings

Divorcing couples in Colorado may hope to avoid lengthy and expensive litigation. While ending a marriage often places a great emotional strain on the spouses involved, our attorneys may be able to provide options that allow the process to be a more amicable and less combative experience. You may wish to consider these alternative dispute resolution methods if you are raising children and hope to maintain a civil relationship with your former spouse.

Arbitration is a binding form of dispute resolution. If you decide to pursue this option, an arbitrator will make a decision after hearing arguments from both you and your spouse. While mediation is a similar process, it is not binding. If you decide to enter into mediation, you may opt out and pursue litigation if you are unsatisfied with the results.

Alternative dispute resolution could allow you to come to an amicable agreement with your former spouse while avoiding the high costs and emotional strain of litigation. Our attorneys with experience in this area may be able to explain the process, and they could also act as an independent mediator or arbitrator.

The decision to seek a divorce is often a difficult one, and important practical matters are sometimes not given their due consideration because of the pressure the parties involved are under. If you wish to avoid an adversarial divorce, you may choose to consider alternative dispute resolution methods. We could explain how these methods work in practice, and we may also be able to prepare you for what lies ahead if you elect to take this path.
