What Types of Divorces Do We Navigate for Our Clients?

Colorado is a no-fault divorce state. The only grounds for divorce accepted by Colorado family court is for one spouse to find that the marriage is irretrievably broken. Once one spouse files the divorce petition, the other spouse (the respondent) has up to 21 days to respond. Then, most divorces fall into two categories:

  • Uncontested divorce, or a divorce that does not require a trial because the spouses are able to arrive at mutually acceptable divorce terms with the help of their attorneys and professional mediation to craft a settlement agreement, after which the attorneys present it to the judge to sign into binding divorce orders
  • Contested divorce, or a divorce in which the spouses have one or more unresolved disputes which require a trial during which each side presents their arguments to a judge who makes final decisions and signs them into divorce orders

At Ciancio Ciancio Brown, P.C., we also represent clients in collaborative divorces. In a collaborative divorce, both spouses make a binding legal agreement to collaborate throughout all divorce-related decisions and reach agreements without going to court.

What Divorce Terms are Required in Colorado?

The attorneys at Ciancio Ciancio Brown, P.C. are well-versed and highly experienced in assisting divorcing clients through the following required terms of divorce in Colorado:

  • Child custody and shared parenting time schedules
  • Child support under the state’s income shares model
  • Division of marital assets and debts in a way that’s “fair and equitable”
  • Spousal maintenance (alimony)

After a spouse files a divorce petition in Colorado, the state requires a 91-day waiting period before finalizing the divorce. During this period, both spouses must make full financial disclosures.

A Castle Rock family law attorney helps their client navigate all of the above divorce requirements with the goal of achieving low-conflict resolutions whenever possible without compromising their clients’ rights and best interests.

The Division of Assets In Castle Rock, Colorado Divorces

Colorado’s divorce law follows an equitable distribution model for asset division. This model allows each spouse to retain their separate property, or all assets that belonged solely to them before the marriage, were gifted to them, or were inherited by them during the marriage, while they must fairly divide all assets accumulated during the marriage, regardless of whose name is on the deed, title, or account.

Understanding Child Custody and Child Support In Castle Rock, Colorado

Child custody in Colorado refers to both legal (decision-making) custody and physical custody, or parenting time. Colorado family courts make all decisions in the child’s best interests. Under this requirement, the courts begin with the presumption that frequent close contact with both parents is in the best interests of children.

If one parent believes that it’s not in their child’s best interests to spend equal time with the other parent, they must present their evidence to the court for the judge to examine. The judge hears from both sides before making a child custody decision.

Legal Separation vs. Divorce In Colorado

Colorado is one of the majority of states that allow legal separation as an alternative to divorce. In a legal separation, the spouses or a judge must decide the same terms as in a divorce. The settlement agreement or judge’s orders are binding and enforceable, just as in divorce; only the spouses remain legally married.

Spouses may choose this option for emotional reasons, such as to honor religious beliefs or allow for a reconciliation, or for practical purposes, such as to continue one spouse’s health insurance coverage or for tax savings.

Modifying Existing Orders In Castle Rock Family Law Cases

At Ciancio Ciancio Brown, P.C., we understand that circumstances change, while family court orders are binding and enforceable. If you’ve experienced a substantial permanent change in your financial or medical status, you have the right to petition for a modification of your divorce orders. We help our clients make compelling modification requests that accurately reflect their changed circumstances.
